This document describes the operational rules that apply to this topic across HOSTPHOX services.
Agreement and contracting entity
These Terms form the service agreement between the customer identified in an order, account or invoice and the CAPTEC GROUP contracting entity identified there. HOSTPHOX is a brand of CAPTEC GROUP.
Using, ordering or renewing a service means you accept these Terms, the applicable order, product terms and incorporated policies.
Eligibility and accounts
You must have legal capacity to contract and provide accurate account, billing and contact information. If you act for an organisation, you represent that you are authorised to bind it.
You are responsible for credentials, authorised users and activity through your account and must report suspected compromise promptly.
Orders, fees and renewal
Orders are subject to availability, verification, payment, fraud screening and technical feasibility. Provisioning times are estimates unless expressly committed.
Prices, billing periods, renewal terms and taxes are those shown at checkout, in the portal or accepted order. Website FX conversions are reference values; checkout determines the final amount and currency.
Customer content and acceptable use
You retain ownership of lawful content and grant HOSTPHOX the limited rights necessary to host, transmit, secure, back up and support it.
You are responsible for applications, licences, DNS, mail, security settings, lawful content and independent backups, and must comply with the Acceptable Use Policy.
Domains, backups and migrations
Domain services are subject to registry and registrar rules. Registration is not final until confirmed by the relevant registry or registrar.
Backups, where included, are resilience features rather than a substitute for the customer’s own backup plan unless an order says otherwise. Migrations depend on source access and compatibility.
Availability, suspension and termination
Published uptime targets are governed by the SLA. Planned maintenance, customer-caused incidents and stated exclusions may not count as downtime.
We may suspend or terminate for non-payment, fraud, unlawful use, material breach or urgent security risk, with notice where reasonable and lawful.
Warranties and liability
Services are provided with commercially reasonable care and skill. Except for express commitments and mandatory law, services are provided as available and may be affected by third-party dependencies.
Nothing excludes liability that cannot lawfully be excluded. Subject to mandatory law, indirect or consequential losses are excluded and aggregate liability is limited to fees for the affected service during the preceding twelve months unless an accepted order states otherwise.
Changes, notices and disputes
We may update Terms for legal, security or operational reasons and will communicate material changes through a reasonable channel.
The contracting entity, governing law and forum may be stated on the accepted order or invoice. Mandatory consumer rights remain unaffected. Notices may be sent through the portal or to help@hostphox.com.
